Terms of Use

You represent and warrant that:

1. you are at least the age of majority in your jurisdiction of residence;
2. you have the legal capacity to enter into these Terms;
3. all information you provide to us is true, accurate, current, and complete;
4. your use of the Services will comply with all applicable laws, rules, and regulations; and
5. you are using the Services solely for lawful personal or internal business purposes, as permitted by these Terms.

The Services are not directed to children under the age of majority. We do not knowingly permit minors to create accounts except where expressly authorized by us and lawfully consented to by a parent or guardian.

Finding Wealth is a financial organization, planning, educational, informational, and technology platform. The Services may include budgeting tools, transaction display tools, financial planning tools, cash-flow and debt-planning features, points and rewards features, educational content, alerts, and AI-generated outputs.

The Services are provided for informational, organizational, and educational purposes only. Unless expressly stated otherwise in a separate written agreement signed by an authorized representative of Finding Wealth, Finding Wealth is not acting as your financial advisor, portfolio manager, securities dealer, insurance representative, mortgage broker, accountant, lawyer, or fiduciary.

No content made available through the Services constitutes legal, tax, accounting, investment, credit, insurance, mortgage, or other regulated professional advice, recommendation, solicitation, or offer.

To access certain Services, you may be required to create an account. You agree to maintain the confidentiality of your credentials and to restrict access to your device(s) and account. You are solely responsible for all activities occurring under your account, whether or not authorized by you, except to the extent caused by our gross negligence or wilful misconduct.

You agree to notify us immediately of any actual or suspected unauthorized access, compromise, misuse, or breach relating to your account or credentials. We reserve the right to suspend, restrict, or terminate access where we reasonably suspect fraud, abuse, unlawful conduct, security risks, or violations of these Terms.

You may choose to upload, input, import, sync, or otherwise provide information to the Services, including account information, transaction data, budgeting data, goals, communications, documents, or prompts (“User Data”). You hereby grant us a worldwide, non-exclusive, revocable, limited license to host, store, process, reproduce, analyze, format, transmit, and otherwise use User Data as reasonably necessary to provide, maintain, secure, improve, personalize, and support the Services, subject to our Privacy Policy and applicable law.

Where we offer account-linking or third-party integrations, you acknowledge that:

1. such integrations may be provided by third-party partners or intermediaries;
2. access to third-party data depends on those providers and may be delayed, incomplete, inaccurate, or unavailable;
3. we do not control third-party systems, institutions, or data sources; and
4. you are responsible for ensuring that you have authority to connect any account or provide any data you submit to the Services.

You shall not, and shall not permit any third party to:

1. use the Services for any unlawful, fraudulent, deceptive, abusive, defamatory, harassing, or harmful purpose;
2. interfere with, disrupt, damage, reverse engineer, scrape, probe, or test the vulnerability of the Services or related systems, except as expressly permitted by applicable law;
3. use any automated means, including bots, crawlers, scripts, or data-mining tools, to access or extract from the Services without our prior written consent;
4. upload or transmit viruses, malware, spyware, malicious code, or other harmful materials;
5. misrepresent your identity, affiliation, financial status, or authority;
6. submit sensitive information belonging to another person without lawful authority and all required consents;
7. use the Services to build or train a competing product, model, or dataset, except as expressly permitted by us in writing; or
8. circumvent any security feature, paywall, usage cap, access restriction, or technological measure implemented by us.

Certain Services may be offered on a paid subscription, one-time purchase, promotional, trial, or premium basis. By purchasing a subscription or paid feature, you agree to pay all fees, taxes, and other applicable charges disclosed at the time of purchase.

Unless otherwise stated at the point of sale, subscriptions renew automatically for successive terms equal in length to the initial subscription term, and the payment method on file will be charged automatically unless you cancel before renewal. Fees are non-refundable except as expressly stated by us, required by applicable law, or otherwise determined by us in our sole discretion.

We reserve the right to change our pricing, packaging, features, or subscription structure prospectively. Any such change shall apply only as permitted by applicable law and any applicable platform terms, and shall not deprive you of rights that cannot lawfully be waived.

We may offer free trials, promotional pricing, limited beta access, invite-only features, or goodwill credits at our discretion. We may modify, withdraw, or terminate such offers at any time, subject to applicable law. Eligibility for promotional offers may depend on account status, geography, prior usage, billing history, or other criteria determined by us.

The Services include Horizon AI and other AI-powered features that may provide chat responses, summaries, suggestions, categorizations, prioritization, educational insights, scenario comparisons, forecasts, or other machine-generated outputs. Horizon AI is an educational and informational tool only. You acknowledge and agree that:

1. Horizon AI and all AI outputs are provided for educational and informational purposes only and do not constitute financial, investment, tax, legal, insurance, mortgage, credit-counselling, or any other regulated professional advice;
2. no fiduciary, advisory, or professional relationship is created between you and Finding Wealth by your use of Horizon AI or any other AI feature;
3. AI outputs may be incomplete, inaccurate, outdated, non-personalized, or inappropriate for your circumstances;
4. AI-generated outputs are probabilistic and may contain errors, omissions, or hallucinations;
5. you remain solely responsible for independently reviewing, validating, and determining whether to rely on any output; and
6. no AI output shall be construed as a promise, guarantee, warranty, or professional recommendation.

We may monitor interactions with AI features for safety, abuse prevention, troubleshooting, product improvement, quality assurance, and compliance purposes, subject to our Privacy Policy and applicable law.

The Services, including all software, code, designs, interfaces, graphics, layouts, trademarks, service marks, trade names, logos, text, compilations, databases, audio, video, AI prompt structures, features, and content made available by us, excluding User Data, are and shall remain the sole and exclusive property of Finding Wealth and/or its licensors and are protected by intellectual property and other applicable laws.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal, non-commercial use or internal permitted business use during the term of these Terms.

No right, title, or interest is transferred to you except as expressly set out herein.

If you provide us with suggestions, comments, ideas, improvements, requests, ratings, bug reports, or other feedback regarding the Services (“Feedback”), you hereby grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, transferable, sublicensable license to use, reproduce, modify, adapt, publish, distribute, commercialize, and otherwise exploit such Feedback without restriction, attribution, or compensation to you.

The Services may contain links to, integrations with, or dependencies on third-party services, financial institutions, data providers, payment processors, app stores, analytics providers, cloud providers, and AI providers. Current third-party integrations include, without limitation:

1. Plaid Technologies, Inc. — bank account connectivity and transaction data. Plaid's use of your data is governed by Plaid's own End User Privacy Policy. Finding Wealth receives read-only access to account and transaction data authorized by you.
2. Stripe, Inc. — payment processing for card-based subscriptions and one-time purchases. Your payment data is handled by Stripe subject to Stripe's own terms and privacy policy.
3. PayPal Holdings, Inc. — alternative payment processing. PayPal transactions are subject to PayPal's User Agreement and Privacy Statement.
4. Supabase, Inc. — database and authentication infrastructure.
5. Anthropic, PBC — AI model provider powering Horizon AI features.
6. Other providers for analytics, error monitoring, hosting, and related infrastructure.

We do not control and are not responsible for any third-party services, content, policies, terms, acts, omissions, systems, outages, or data practices. Your use of third-party services may be subject to separate terms and privacy practices. We encourage you to review them carefully.

We may add, remove, alter, suspend, disable, discontinue, or restrict any part of the Services, temporarily or permanently, at any time, with or without notice, including for maintenance, upgrades, legal compliance, business reasons, fraud prevention, abuse prevention, or security concerns.

We do not guarantee that the Services will be uninterrupted, error-free, secure, or available at all times or in all jurisdictions.

We may amend these Terms from time to time. When we do, we may post a revised version, update the "Last Updated" date, and where appropriate or required by law, provide additional notice by email, in-app notification, account notice, or other reasonable means.

To the maximum extent permitted by applicable law, your continued access to or use of the Services after the effective date of revised Terms constitutes your acceptance of those revised Terms.

Notwithstanding the foregoing, no amendment shall be enforced against you in a manner prohibited by applicable law. Where applicable law requires advance notice, an express opportunity to refuse, cancellation rights, or separate consent for certain amendments, those requirements shall prevail.

You may stop using the Services at any time and may terminate your account in accordance with any account deletion process we make available.

We may, without liability and without prior notice where reasonably necessary, suspend, restrict, deactivate, or terminate your account or access to all or any part of the Services if:

1. you breach these Terms;
2. we reasonably suspect fraud, abuse, unlawful conduct, or security risks;
3. required by law, court order, regulator, payment partner, or platform provider;
4. your payment method fails and fees remain overdue; or
5. continued provision of the Services is no longer commercially or operationally feasible.

Termination shall not affect any accrued rights, remedies, payment obligations, disclaimers, limitations of liability, indemnities, or survival clauses.

THE SERVICES ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. WITHOUT LIMITING THE FOREGOING, THE COMPANY DISCLAIMS ALL REPRESENTATIONS, WARRANTIES, CONDITIONS, AND GUARANTEES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR COLLATERAL, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, COMPLETENESS, QUIET ENJOYMENT, SECURITY, AVAILABILITY, OR RESULTS.

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, WE DO NOT WARRANT THAT:

1. THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;
2. ANY FINANCIAL DATA, TRANSACTION DATA, POINTS DATA, CREDIT-RELATED DATA, OR THIRD-PARTY DATA WILL BE COMPLETE, ACCURATE, CURRENT, OR ERROR-FREE;
3. ANY AI OUTPUT WILL BE CORRECT, SUITABLE, PERSONALIZED, OR FIT FOR DECISION-MAKING;
4. THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR
5. ANY DEFECTS OR ERRORS WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, AGGRAVATED, PUNITIVE, OR MULTIPLE DAMAGES, OR FOR ANY LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF OPPORTUNITY, LOSS OF GOODWILL, LOSS OF DATA, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, HOWEVER CAUSED, WHETHER IN CONTRACT, TORT, EXTRA-CONTRACTUAL LIABILITY, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF:

1. THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO US FOR THE SERVICES IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
2. CAD $100.

Nothing in these Terms shall exclude or limit liability to the extent such exclusion or limitation is prohibited by applicable law.

You agree to defend, indemnify, and hold harmless Finding Wealth and its affiliates, officers, directors, employees, contractors, licensors, and agents from and against any and all claims, demands, proceedings, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or relating to:

1. your use or misuse of the Services;
2. your User Data;
3. your breach of these Terms;
4. your violation of any law or the rights of any third party; or
5. your fraud, negligence, or wilful misconduct.

These Terms shall be governed by and construed in accordance with the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict of laws principles.

Subject to any mandatory rights you may have under consumer protection law, you attorn irrevocably to the exclusive jurisdiction of the courts of the judicial district of Montréal, Québec, for the resolution of any dispute arising out of or relating to these Terms or the Services.

The parties confirm that they have requested that these Terms and all related documents be drawn up in English. Les parties reconnaissent avoir exigé que les présentes conditions et tous les documents qui s'y rattachent soient rédigés en anglais.

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

No waiver by Finding Wealth of any breach or default shall be deemed a waiver of any preceding or subsequent breach or default.

These Terms, together with any policies or documents expressly incorporated by reference, constitute the entire agreement between you and Finding Wealth regarding the Services and supersede all prior or contemporaneous communications, understandings, and agreements relating thereto.
